U.M.KOGYO INC. ( “the Company”) is committed to the following privacy policy regarding the handling of personal information of the Registerd User (including the person in charge of the suppliers) in the services provided on this website ("the Services").

Article 1 Personal Information

The term “personal information” refers to “personal information” as defined in the Personal Data Protection Act, i.e. information on living individuals that can identify specific individuals by name, date of birth, age, gender, occupation, address, telephone number, e-mail address, contact details and other descriptions and personal identification information contained in the Information Carrier of bank account numbers, credit card numbers, etc..

Article 4 Change of purpose of use

Article 5 Provision of personal information to third parties

1 . The Company shall not provide personal information to third parties without the prior consent of the customer. However, this excludes cases permitted under the Personal Data Protection Act and other laws and regulations as in the following cases:

  • (1) When required by law.
  • (2) When it is necessary for the protection of a person's life, body or property and it is difficult to obtain the consent of the person concerned.
  • (3) When it is particularly necessary to improve public health or to promote the sound development of children and it is difficult to obtain the consent of the person concerned.
  • (4) When it is necessary to cooperate with a state organ, a local authority or an individual or entity entrusted in executing the affairs prescribed by law, and obtaining the consent of the person is likely to impede the execution of the affairs in question.
  • (5) When the following matters have been notified or published in advance and the Company has notified the Personal Data Protection Commission:
    • 1. the purpose of use including the provision of data to third parties
    • 2. the data items to be provided to third parties
    • 3. the means or method of provision to third parties
    • 4. the provision of personal data to third parties is stopped at the request of the customer,

    • 6. any other cases permitted by law

2 . notwithstanding the provisions of the preceding paragraph, the party to whom the information is provided shall not fall under the category of third party in the following cases:

  • 1. when the handling of personal information is outsourced in whole or in part to a third party within the scope necessary for the achievement of the purpose for which it is used by the Company.
  • 2. when personal information is provided as a result of the succession of business due to merger or other reasons.
  • 3. when personal information is used jointly with specific persons, and where the user is notified in advance or is made readily accessible to the items of personal information to be used jointly, the scope and the purpose of the joint use by the specific persons and the name of the person responsible for the management of the personal information.

Article 6 Safety control measures

  • 1.the Company shall endeavour to manage the personal information received from the Customer in an accurate and secure manner.
  • 2.appropriate security measures against unauthorised access, computer viruses, etc.
  • 3.for the organisational management of personal information, the handling method is strictly defined in the company regulations and the information is thoroughly handled in accordance with these regulations.
  • 4. in the event that the handling of personal information is outsourced in whole or in part to an external contractor, the contractor is selected on the condition that the personal information will be handled properly and managed appropriately.

Article 7 Disclosure of personal information

  • 1. If the person in question requests disclosure of his/her personal information, the Company shall disclose the information to the person in question without delay. However, we may decide not to disclose all or part of the information if any of the following applies.
    • 1. where there is a risk of harm to the life, body, property or other rights or interests of the person concerned or the third party.
    • 2. if there is a risk of significant hindrance to the proper conduct of our business.
    • 3. if we cannot confirm that the request for disclosure is made by the person concerned.
    • 4. in any other case where such disclosure would be in breach of the law;
  • 2. Notwithstanding the provisions of the preceding paragraph, information other than personal information such as historical and characteristic information, will not be disclosed in principle.
  • 3. If the tax office or the police request disclosure of personal information, this will be disclosed to the tax office or the police without delay.

Article 8 Correction and deletion of personal data

  • 1. The customer may request the correction, addition or deletion of personal information to the Company in accordance with the procedures set by the Company if the personal data held by the Company is incorrect.
  • 2 If the Company receives a request from the Customer as described in the preceding paragraph and deems it necessary to comply with the request, the Company shall correct,add or delete the personal information concerned without delay.
  • 3.If the Company makes a correction, adition or deletion based on the preceding paragraph or decides not to make a correction, the Company shall notify the Customer of this, without delay.

Article 9 Suspension of use of personal information

  • 1. If a request is made for the suspension of use or deletion (”suspension of use”) of personal information on the grounds that it has been handled beyond the scope of the purposes for which it was used or that it was obtained by unlawful means, the necessary investigation will be carried out without delay.
  • 2. If, based on the results of the investigation in the preceding paragraph, we consider it necessary to comply with the request, we will suspend the use of the personal data concerned without delay.
  • 3. If the Company suspends the use of personal data in accordance with the preceding paragraph or decides not to suspend the use of personal data, the Company will notify the customer of this, without delay.
  • 4. Notwithstanding the preceding two paragraphs, if it is difficult to suspend the use of personal data, such as when the suspension of the use involves a large amount of expense, and if alternative measures necessary to protect the rights and interests of the customer can be taken, these alternative measures shall be taken.

Article 10 Changes to privacy policy

  • 1 The content of this policy may be changed without notice to the customer, except as otherwise provided for in the law or in this policy.
  • 2 Unless otherwise specified by the Company, the amended Privacy Policy shall take effect from the time it is posted on the Website.
